How to register an escort business in Kansas

Kansas. Land of sunflowers, Chryslers and the occasional buffalo. Home to Amelia Earhart, Dwight D. Eisenhower and Bob Dole. Historically you've liked your steak well done and your cherry pie without ice cream. And, of course, through you we've learned that there truly is no place like home.

Kansas is also a hearty state in which to register your small escort business, and in this article you'll find clear step-by-step advice on how to do just that. For more information on why it's vitally important to register your business, refer to our article Don't get busted for tax evasion: Why registering your escort business is the only option.

Step four: Register your business / business name

Sole Proprietorship:

In Kansas you are not required to register your sole proprietorship escort business as a separate business entity: because the business is you, it is not recognized as a separate business and you'll file your business information along with your own personal taxes.

You are also not required to register a DBA name in Kansas—one of few states to not require this. Good job, Kansas!

If you would like to guarantee sole usage of this name, the state suggests that you consult a business attorney.

Partnership:

In Kansas you are not required to register your general partnership business as a separate business entity. However, you can choose to file a Statement of Authority or Partnership Agreement with the Secretary of State. In this way your rights and duties as partners will be a bit more defined. You will also have to file a partnership return come tax time, so having your books in order is very important. More on that below.

You are also not obligated to register your business name in Kansas, whether it is or is not a DBA name.

Corporation:

To register your escort corporation in Kansas you'll need to file your Articles of Incorporation (form CF 51-01) with the Kansas Secretary of State. You can find this form at the Kansas Secretary of State—Business Entities. There is a $90 filing fee for this form.

The form contains basic information about the corporation, including the distributed shares and methods of operation. While the form itself may look simple, it is highly suggested that you consult a business lawyer when setting up your corporation.

LLC:

To register your escort LLC in Kansas, you'll need to file your Certificate of Organization (CF 51-09 form) with the Kansas Secretary of State. The file contains basic information about the members and who will manage the company. There is a $165 filing fee for this form.

Step six: Register for your federal and Kansas state taxes

There are a few basic types of taxes small businesses in Kansas may register for.

  1. Individual Income Tax: If you're a sole proprietor or LLC, you'll file your business profits/losses in a Schedule EZ form that will go along with your personal income tax 1040 form. For more information go to IRS.gov. You can also find more forms and information at the Kansas Department of Revenue—Individual Income.
  2. Business Taxes: Businesses in Kansas have to pay corporate taxes. Partnerships and LLCs must file a Partnership Income Tax Return (form K-65), and corporations must file a Corporation Tax Return (form IRS-1120). You can find more information on these taxes and register your business for taxes online at the Kansas Department of Revenue—Business Tax Registration.
  3. Unemployment Insurance: All businesses with employees pay unemployment insurance to safeguard the state's unemployed. You can get more information and file online at the Kansas Department of Labor.
  4. Withholding Taxes: Employers must withhold taxes from employees for their personal income taxes. More information can be found about withholding taxes in Kansas at the Kansas Department of Revenue—Forms and Publications, Withholding.
  5. Workers Compensation: If you have employees, you'll have to pay Worker's Compensation. More information can be found at the Workman's Compensation Service Center.
  6. Self-Employment Taxes: If you own and operate your business and are not paid as an employee, you'll need to file your own self-employment taxes for social security and Medicaid. This is particularly true for sole proprietorships, general partnerships and LLCs. You can find this Schedule C / 1040 form and get more information at IRS.gov.

Step seven: Get necessary licenses and permits

There is no one basic "business license" in Kansas, and chances are your city won't require you have one. But you will have to make sure your business is registered with state and it's wise to check with your city/county to make sure any other permits are not required. Alternatively, you can use the IRS's Permit Me tool.
